Terms of Service

1. Agreement to Terms

By subscribing to, accessing, or using any product or service offered by Volta Lawn Intelligence Inc. ("Volta," "we," "us," or "our"), including the Lawn Companion™ hardware device, the Lawn Intelligence™ platform, Lawn Chat™, and any associated mobile or web applications (collectively, the "Service"), you ("Customer," "you," or "your") agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms in their entirety, you must not subscribe to or use the Service.


2. Nature of the Service

2.1 Subscription Service

Volta provides a subscription-based Lawn Wellness service. The Lawn Companion™ hardware device is included as part of your active subscription plan and is not sold as a standalone product. Subscribing to Volta is not a retail purchase; it is an ongoing service relationship governed by these Terms.

2.2 Subscription Plans

Volta offers multiple subscription tiers. Details of features, pricing, and billing cycles applicable to your selected plan are presented at checkout and incorporated into these Terms by reference. Volta reserves the right to modify plan offerings with reasonable notice to existing subscribers.

2.3 Operative Conditions

The Lawn Companion™ is designed to operate within declared Operative Conditions, including but not limited to: lawn perimeter dimensions, slope gradient, grass type, ground surface condition, and obstacle density. These parameters are disclosed on our website and during the checkout process. Performance of the Service is contingent upon your lawn meeting these conditions.

By completing your subscription, you represent that your lawn meets the declared Operative Conditions.


3. Billing and Payment

3.1 Initial 24-Month Commitment Period

All Volta subscriptions are subject to a minimum 24-month commitment period ("Commitment Period") beginning on the date your subscription is activated. During the Commitment Period, the total subscription amount is either:

  • Financed through one of Volta's authorized financing partners (currently including Affirm and PayPal), in which case billing, payment schedules, interest terms, and late payment consequences are governed by your agreement with the applicable financing partner; or
  • Prepaid in full at checkout, in which case no further charges apply during the Commitment Period unless additional services are selected.

By subscribing, you acknowledge and accept the 24-month commitment and agree that early cancellation during the Commitment Period does not entitle you to a refund of amounts already paid or financed, except as expressly provided in Section 6.

3.2 Post-Commitment Period — Plan Selection

Upon expiration of the 24-month Commitment Period, your Service will stop automatically. Volta will notify you at least 60 days before the end of your Commitment Period to inform you of your options. At that time, you may actively choose to:

  • Continue with your current plan on a recurring monthly or annual basis;
  • Upgrade or downgrade to a different Volta service or care tier.

No charges will be applied after the Commitment Period without your explicit opt-in. If no plan is selected, the Service concludes at the end of the Commitment Period and the Lawn Companion™ transfers to your ownership per Section 7.2.

3.3 Failed Payments

If a payment to Volta or a financing partner fails, Volta may suspend access to the Service until payment is successfully resolved. Continued non-payment may result in termination of the subscription and, where applicable, recovery of the Lawn Companion™ device per Section 7.2.

3.4 Price Changes

Volta may adjust post-Commitment Period subscription pricing with at least 30 days' written notice to your registered email address. Pricing is locked for the duration of the Commitment Period and cannot be increased during that term. Continued use of the Service after a price change takes effect constitutes acceptance of the revised pricing.


4. Hardware — Lawn Companion™

4.1 Included Hardware

The Lawn Companion™ device is provided to you as part of your active subscription under the Infinite Care™ program. Title to the hardware does not transfer to you. The device remains the property of Volta Lawn Intelligence Inc. at all times.

4.2 Care and Use

You agree to use the Lawn Companion™ only in accordance with its documentation and within the declared Operative Conditions. You are responsible for reasonable care of the device while it is in your possession.

4.3 Hardware Replacement

If the Lawn Companion™ arrives damaged or fails to function within the declared Operative Conditions due to a manufacturing defect or Volta-attributable cause, Volta will, at its sole discretion, repair or replace the unit at no additional charge. Replacement is subject to the telemetry validation and dispute process described in Section 6.


5. Telemetry and Data

5.1 Operational Telemetry

The Lawn Companion™ continuously collects operational telemetry data, including but not limited to: session logs, mowing zone maps, error states, environmental sensor readings, and device health metrics (collectively, "Telemetry Data"). This data is transmitted to Volta's servers and retained in accordance with our Privacy Policy.

5.2 Use of Telemetry Data

Telemetry Data is used to:

  • Operate and improve the Lawn Intelligence™ platform
  • Diagnose hardware and software issues
  • Validate service performance and operative conditions
  • Evaluate refund, replacement, and dispute claims under Section 6
  • Generate lawn health insights delivered through the Service

5.3 Telemetry as Ground Truth

In any dispute, refund request, or return evaluation, Telemetry Data constitutes the primary factual record. Volta's analysis of Telemetry Data is binding on the dispute evaluation process. Customer assertions unsupported by Telemetry Data do not independently constitute grounds for a refund or replacement.


6. Returns, Refunds, and Disputes

6.1 No Return Without Cause

Volta is a subscription service. Returns and refunds are not available on the basis of buyer's remorse, change of mind, or preference. The Service must be used within the declared Operative Conditions. A decision not to use the Service does not constitute grounds for a refund.

6.2 Mandatory Telemetry Validation

All refund and return requests are subject to a mandatory review of Telemetry Data by Volta's technical team. No refund or return will be processed before telemetry validation is complete. Volta will initiate this review within a reasonable time following receipt of a written request.

6.3 Customer Cooperation Required

You agree to actively cooperate with Volta's support and diagnostic process before any return or refund is considered. Cooperation includes, but is not limited to:

  • Responding to support communications within a reasonable timeframe
  • Providing access to the device and lawn as reasonably requested
  • Attempting recommended remediation steps

Failure to cooperate will result in forfeiture of any refund or replacement claim.

6.4 Outcome Categories

Following telemetry validation and, where required, customer cooperation, refund and return requests are resolved according to the following framework:

6.5 Goodwill Settlements

A 50/50 goodwill settlement, where offered, is made without admission of liability by either party. Acceptance of a goodwill settlement constitutes full and final resolution of the relevant dispute.

6.6 Submission of Requests

All refund and return requests must be submitted in writing to support@volta.ai with your account email, subscription ID, and a description of the issue. Requests submitted without this information will not be processed.


7. Cancellation

7.1 Cancellation During the Commitment Period

Cancellation is not available during the 24-month Commitment Period. All amounts committed to under Section 3.1 — whether financed through a third-party partner or prepaid — remain due in full regardless of any cancellation request. Early termination of a financing agreement is governed solely by the terms of your agreement with the applicable financing partner (Affirm, PayPal, or other). Volta does not issue refunds for the Commitment Period under any circumstance other than those expressly provided in Section 6.

7.2 End of Commitment Period and Optional Continuation

Upon completion of the 24-month Commitment Period, the Service concludes automatically. Title to the Lawn Companion™ device transfers to you at no additional charge. You are not required to return the device.

If you have opted into a continuation plan per Section 3.2, you may cancel at any time through your account dashboard or by contacting support@volta.ai. Cancellation takes effect at the end of your current billing cycle. No partial refunds are issued for unused days within a paid billing period. Upon cancellation, Volta's Infinite Care™ coverage and all cloud-based services (Lawn Intelligence™, Lawn Chat™) will cease at the end of the final paid billing cycle.

7.3 Device Return — Termination During the Commitment Period

If a subscription is terminated during the Commitment Period for any reason — including termination by Volta under Section 7.4 — you agree to return the Lawn Companion™ device to Volta within 14 days of the termination effective date, at your own cost and using a trackable shipping method. Failure to return the device within this window may result in a hardware recovery fee reflecting the current replacement value of the unit.

7.4 Termination by Volta

Volta reserves the right to terminate your subscription immediately for cause, including but not limited to: misuse of the hardware, violation of these Terms, non-payment, or fraudulent dispute activity. In such cases, no refund will be issued for the current billing period, and the device must be returned per Section 7.3.


8. Intellectual Property

All technology, software, algorithms, trademarks, trade names, and content comprising the Volta Service — including Lawn Intelligence™, Drop&Mow®, Privacy by Physics™, Infinite Care™, and Lawn Chat™ — are the exclusive property of Volta Lawn Intelligence Inc. and are protected by applicable US and international intellectual property laws. No license to any intellectual property is granted to you by virtue of your subscription, except the limited right to use the Service for its intended purpose during your active subscription term.


9. Privacy

Your use of the Service is also governed by Volta's Privacy Policy, available at volta.ai/privacy-policy, which is incorporated into these Terms by reference. By subscribing, you consent to the collection, processing, and use of your data as described therein, including Telemetry Data as specified in Section 5.


10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VOLTA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. VOLTA DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY SPECIFIC LAWN OUTCOME WILL BE ACHIEVED.


11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, VOLTA'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL SUBSCRIPTION FEES PAID BY YOU IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IN NO EVENT SHALL VOLTA BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.


12. Indemnification

You agree to indemnify, defend, and hold harmless Volta Lawn Intelligence Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your breach of these Terms; or (c) your violation of any applicable law or third-party right.


13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association (AAA), with proceedings conducted in English. The arbitration shall take place in Delaware unless otherwise agreed in writing. Nothing in this Section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.


14. Changes to These Terms

Volta reserves the right to modify these Terms at any time. Material changes will be communicated to your registered email address at least 30 days before taking effect. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must cancel your subscription before the effective date.


15. Entire Agreement

These Terms, together with the Privacy Policy and any plan-specific terms presented at checkout, constitute the entire agreement between you and Volta Lawn Intelligence Inc. with respect to the Service and supersede all prior agreements, representations, and understandings.
